These Terms of Service ("Terms") govern your use of the aSpot mobile application ("App") operated by REYCO Innovations ("we," "us," or "our"). By downloading or using aSpot, you agree to be bound by these Terms. If you do not agree, do not use the App.
Section 01
Acceptance of Terms
By tapping "I Agree" on first launch or by continuing to use aSpot, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you are using aSpot on behalf of a business, you represent that you have authority to bind that business to these Terms.
Section 02
Description of Service
aSpot is a crowd-sourced parking assistant designed to help drivers locate available street parking. The App provides:
- A live map of street parking spots generated from OpenStreetMap road geometry
- Turn-by-turn navigation to selected parking spots
- A parking availability forecast tool (Plan My Parking)
- Spot reporting — allowing users to mark spots as available, occupied, or flag issues
- A parked car saver to help you find your way back to your vehicle
- Vehicle profile management
Section 03
Crowd-Sourced Data Disclaimer
aSpot is a crowd-sourced service. Parking spot availability, status, and location data displayed in the App is generated algorithmically and reported by users. This data may be inaccurate, outdated, or incomplete.
REYCO Innovations does not guarantee the accuracy, completeness, or reliability of any parking information displayed in aSpot. You are solely responsible for verifying parking availability and legality before parking your vehicle.
Section 04
No Liability for Parking Violations or Vehicle Damage
By using aSpot, you acknowledge and agree that:
- REYCO Innovations is not responsible for parking tickets, fines, towing fees, or violations you receive as a result of relying on information in the App
- REYCO Innovations is not responsible for any damage to or theft of your vehicle
- It is your sole responsibility to comply with all applicable parking laws, signs, regulations, and restrictions at your parking location
- Street signs and posted regulations always take precedence over information displayed in the App
- Alternate side parking rules, street cleaning schedules, and temporary restrictions may not be reflected in the App
Section 05
Navigation Advisory
The turn-by-turn navigation feature in aSpot is provided for convenience only. You must:
- Keep your eyes on the road and drive safely at all times
- Comply with all traffic laws and signals regardless of navigation instructions
- Use your own judgment — do not follow navigation instructions that would require you to violate traffic laws or endanger yourself or others
REYCO Innovations is not liable for accidents, traffic violations, or damages arising from the use of the navigation feature.
Section 06
User-Generated Content and Spot Reports
When you submit a spot report — marking a spot available, occupied, or flagging an issue — you grant REYCO Innovations a worldwide, royalty-free, perpetual license to use, store, and display that report as part of the aSpot service and any aggregated data derived from it.
You agree not to submit false, misleading, or malicious reports. Deliberately submitting inaccurate reports to mislead other users is a violation of these Terms.
Section 07
Intellectual Property
The aSpot name, logo, application design, and all content produced by REYCO Innovations are the intellectual property of REYCO Innovations and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of aSpot without our express written permission.
aSpot uses the following third-party data under their respective licenses: OpenStreetMap data (© OpenStreetMap contributors, ODbL license) and NHTSA vPIC data (U.S. government public domain).
Section 08
Disclaimer of Warranties
aSpot is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of any parking data, forecast, or navigation instruction.
Section 09
Limitation of Liability
To the fullest extent permitted by applicable law, REYCO Innovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of aSpot, including but not limited to:
- Loss of data
- Parking fines, tickets, or towing costs
- Vehicle damage or theft
- Personal injury
- Lost profits or revenue
To the fullest extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms or your use of aSpot shall be limited to the maximum extent permitted by applicable law.
Section 10
Service Availability
We do not guarantee availability in any specific geographic area or at any specific time. We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice.
Section 11
Changes to Terms
We reserve the right to modify these Terms at any time. We will update the Effective Date when we do. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
Section 12
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
